General Terms and Conditions of Sale

Article 1 – Seller Information

These General Terms and Conditions of Sale govern purchases made through the “tianaproduct” online shop. The seller is TIANA SCOTT, operating as a sole proprietorship under the trade name tianaproduct. Legal company name: Solo proprietorship. SIRET number or business identifier: SSN 287060788. By placing an order, the customer confirms that they have read and accepted these Terms and Conditions. The applicable version is the version displayed on the website when the order is submitted.

Article 2 – Products

The essential characteristics, price, available options, and, where applicable, limitations of each product are described on its product page. Product photographs and illustrations are provided for identification purposes and may show minor differences in color, dimensions, or appearance caused by screens, lighting, packaging updates, or manufacturing variations.

Products are offered subject to availability. If a product becomes unavailable after an order has been placed, the seller will notify the customer promptly and will either offer a suitable alternative, subject to the customer’s express agreement, or cancel and refund the unavailable item.

The customer is responsible for reviewing the product description and confirming that the product is appropriate for the customer’s intended use before placing an order.

Article 3 – Prices

Product prices are shown in the currency displayed at checkout, generally United States dollars unless another currency is expressly indicated. Prices include taxes only where the website or applicable law states that taxes are included. Sales tax, value-added tax, customs duties, shipping charges, and other mandatory charges will be calculated or disclosed before the customer submits the order.

For international deliveries, the customer may be required to pay import duties, customs processing fees, or local taxes charged by the destination country. Unless expressly collected at checkout, these amounts are not included in the purchase price and remain the customer’s responsibility.

The seller may change prices at any time. The price charged is the price displayed and accepted at checkout, except in the case of an obvious pricing or technical error. If such an error occurs, the seller will contact the customer before fulfillment and allow the customer to confirm the order at the correct price or cancel it for a full refund.

Article 4 – Orders

To place an order, the customer selects the desired products, reviews the cart, provides accurate billing and delivery information, selects an available delivery and payment method, and confirms the order after accepting these Terms and Conditions.

Submitting an order constitutes an offer to purchase. An automated order acknowledgment confirms receipt but does not necessarily constitute final acceptance. The sales contract is formed when the seller sends an order confirmation or dispatches the products, whichever occurs first.

The customer must verify all order details before payment. The customer is responsible for ensuring that the name, email address, telephone number, billing information, and delivery address are complete and accurate. Requests to modify or cancel an order should be sent promptly to [email protected]. Changes cannot be guaranteed once processing or shipment has begun.

The seller may refuse or cancel an order for legitimate reasons, including product unavailability, an obvious pricing error, incomplete information, suspected fraud, unauthorized payment, sanctions or legal restrictions, repeated payment incidents, or an order that appears intended for unauthorized resale. Any amount captured for a canceled order will be refunded to the original payment method.

Article 5 – Payment

Payment is due in full when the order is placed. Available payment methods are displayed at checkout and may include major credit cards, debit cards, and supported digital wallets.

Payments are securely processed by Stripe or another payment service provider identified at checkout. The seller does not receive or store the customer’s complete payment card number. Payment processing is also subject to the payment provider’s security checks and terms.

By submitting payment information, the customer confirms that they are authorized to use the selected payment method and authorizes the total amount shown at checkout. The payment provider may perform verification, authentication, fraud-prevention, or authorization checks. An order may be delayed or canceled if payment is declined or cannot be verified.

The transaction may appear on the customer’s bank or card statement under “tianaproduct,” “TIANA SCOTT,” or a shortened version of either name. Customers who do not recognize a charge should contact [email protected] before initiating a payment dispute, without prejudice to any rights provided by their card issuer or applicable law.

Article 6 – Delivery

Orders are normally processed within two to four business days, excluding weekends and public holidays. Estimated delivery times after dispatch are three to eight business days within the continental United States and seven to twenty business days for supported international destinations. These periods are estimates unless the seller expressly guarantees a delivery date at checkout.

Available delivery methods, shipping charges, and estimated delivery times are displayed before payment. Tracking information will be sent by email when tracking is available.

The customer must provide a complete and accessible delivery address. The seller is not responsible for delays or additional costs caused by an incorrect address, refusal of delivery, failure to collect a parcel, customs procedures, or circumstances outside the seller’s reasonable control. If a parcel is returned because of information supplied by the customer or a failure to collect it, reasonable reshipping costs may be charged.

If a shipment is materially delayed, lost, or shown as delivered but not received, the customer should contact the seller promptly. The seller will investigate with the carrier and, where appropriate, arrange a replacement or refund. Customers should report visible shipping damage within forty-eight hours of delivery and retain the product, packaging, and photographs. This reporting period does not limit statutory rights relating to hidden defects or non-conforming goods.

For customers protected by European Union or United Kingdom consumer law, risk of loss passes when the customer or a person designated by the customer, other than the carrier, takes physical possession of the products. In other cases, risk passes as provided by the mandatory law applicable to the transaction.

Article 7 – Right of Withdrawal and Returns

Customers who are consumers in the European Union, European Economic Area, or United Kingdom have the right to withdraw from an eligible distance purchase without giving a reason within fourteen days after the day on which the customer, or a designated third party other than the carrier, receives the product. For orders containing multiple products delivered separately, the period begins upon receipt of the last product.

To exercise the right of withdrawal, the customer must send a clear statement before the deadline to [email protected] or by mail to tianaproduct, TIANA SCOTT, 831 Walnut Street, Toledo, Ohio 43604, United States. The statement should include the customer’s name, order number, products concerned, date received, and an unambiguous request to withdraw.

After giving notice, the customer must return the products within fourteen days to the address above, unless the seller provides a different return address. Products should be securely packaged and, where reasonably possible, returned with their original accessories and documentation. The customer is responsible for direct return shipping costs unless the product is defective, damaged, incorrect, or the seller agrees otherwise.

The customer may inspect a product as they would in a physical shop but may be responsible for diminished value resulting from handling beyond what is necessary to establish the product’s nature, characteristics, and functioning.

The seller will refund eligible payments, including the cost of the least expensive standard delivery method offered for the original order, within fourteen days after receiving the withdrawal notice. The seller may withhold the refund until the returned products are received or the customer supplies evidence of return, whichever occurs first. Refunds are issued to the original payment method unless the customer expressly agrees otherwise. Any additional cost for expedited or premium delivery is not refundable.

The statutory right of withdrawal does not apply to goods made to the customer’s specifications or clearly personalized; sealed goods unsuitable for return for health protection or hygiene reasons after the seal has been opened; goods liable to deteriorate or expire rapidly; or other products legally exempt from withdrawal. Any applicable exclusion will be clearly identified before purchase.

For customers who do not have a statutory withdrawal right, tianaproduct offers a voluntary fourteen-day return period for unused, unworn, unwashed, and undamaged products in their original condition and packaging. The customer must request the return within fourteen days after delivery. Original shipping charges and return shipping costs are not refundable unless the product was defective, damaged, or incorrect. No restocking fee is charged for an accepted return.

Article 8 – Refunds

Approved refunds are sent to the original payment method. After the seller initiates a refund, the customer’s bank, card issuer, or payment provider may require five to ten business days, and occasionally longer, to post it to the customer’s account. The seller does not control this processing period.

If only part of an order is returned, the refund will be limited to the price of the returned products and any shipping amount required by applicable law. Promotional discounts may be recalculated when the conditions of the promotion are no longer met after a partial return.

Article 9 – Legal Guarantees and Product Conformity

The seller guarantees that products will conform substantially to their descriptions and will be free from material defects at the time of delivery. These Terms and Conditions do not exclude, restrict, or replace any mandatory consumer guarantee, implied warranty, or remedy that cannot lawfully be waived.

Customers protected by European Union consumer law benefit from the applicable legal guarantee of conformity, generally for a minimum period of two years from delivery, subject to the law of the customer’s country. Customers may also benefit from legal protection against hidden defects or other mandatory national guarantees.

If a product is defective, damaged, or materially different from the order, the customer should contact [email protected] with the order number, a description of the issue, and clear photographs where reasonably possible. After assessment, the seller will provide an appropriate legal remedy, which may include repair, replacement, price reduction, or refund. The seller will bear reasonable return costs when the product is confirmed to be defective, damaged, incorrect, or non-conforming.

Guarantees do not cover normal wear and tear, accidental damage, misuse, improper storage, unauthorized modification or repair, failure to follow product instructions, or damage caused by external events, except where mandatory law provides otherwise.

Article 10 – Complaints and Customer Service

Complaints should include the customer’s name, order number, contact details, a clear explanation of the issue, and any relevant supporting documents or photographs. The seller aims to acknowledge complaints within three business days and provide a substantive response within fourteen business days.

Nothing in this article prevents a customer from contacting a payment provider, consumer protection authority, court, or other competent dispute-resolution body.

Article 11 – Limitation of Liability

To the maximum extent permitted by law, the seller is not liable for indirect, incidental, special, or consequential losses that were not reasonably foreseeable when the sales contract was formed. The seller’s aggregate contractual liability will not exceed the amount paid for the product giving rise to the claim.

These limitations do not apply to fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, breach of mandatory consumer rights, product liability that cannot legally be excluded, or any other liability that applicable law prohibits the seller from limiting.

Article 12 – Force Majeure

The seller will not be liable for delay or failure caused by events beyond reasonable control, including severe weather, natural disasters, epidemics, war, civil unrest, government action, transportation disruption, customs delays, labor disputes, utility outages, carrier failures, or interruption of communications systems. The seller will notify affected customers where practicable and will take reasonable steps to minimize the consequences.

If such an event prevents fulfillment for an unreasonable period, either party may cancel the affected order. The customer will then receive a refund for products not delivered.

Article 13 – Personal Data

Personal information is processed for order administration, payment, fraud prevention, delivery, customer service, legal compliance, and other purposes described in the shop’s Privacy Policy. Payment information is processed by Stripe or the payment provider displayed at checkout. Customers may exercise applicable privacy rights by contacting [email protected].

Article 14 – Applicable Law and Disputes

These Terms and Conditions and all sales made by tianaproduct are governed by the laws of the State of Ohio and applicable federal laws of the United States, without regard to conflict-of-law principles.

If the customer is a consumer residing outside Ohio, this choice of law does not deprive the customer of mandatory protections granted by the law of the customer’s habitual residence. Nothing in these Terms requires a consumer to waive a right to bring proceedings before a court that has jurisdiction under applicable consumer law.

The parties are encouraged to attempt to resolve any dispute amicably by contacting [email protected]. If no amicable resolution can be reached, disputes may be submitted to the competent courts of Lucas County, Ohio, except where mandatory consumer law permits or requires proceedings in another jurisdiction.

Article 15 – Severability and Entire Agreement

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue in effect. The invalid provision will be interpreted or replaced only to the extent necessary to make it lawful while preserving its intended purpose as closely as possible.

These Terms and Conditions, together with the accepted order, product description, Privacy Policy, and any mandatory information displayed at checkout, constitute the agreement between the seller and the customer concerning the sale.
